TERMS AND CONDITIONS PINK RIBBON AUCTION 2024

These Terms and Conditions ("Terms") govern the online auction hosted by Love Stories Intimates ("we," "us," or "our") on Instagram. By participating in the auction, you ("bidder," "you," or "customer") agree to be bound by these Terms. Please read them carefully before placing any bids.

1. Currency and Bidding

• All bids must be made in EURO (€).
• Binding Bids: Every bid placed is final and binding. Bids cannot be amended, retracted, or revoked once submitted. Please ensure you double-check the bid amount before placing, particularly with last-minute bids.
• Errors in Bids: We are not responsible for any errors you make in bidding. Double-check the amount you enter, especially in a fast-paced bidding environment.

2. Highest Bidder

• If you are the highest bidder at the end of the auction, you are legally obligated to pay for the auctioned item.
• Failure to make payment within the designated time frame may result in forfeiture of your bid and a loss of rights to the item.

3. Payment Terms

• Auction purchases will be invoiced by Love Stories Intimates.
• Payment must be made within 7 working days via bank transfer.
• Failure to make payment within the specified time will result in cancellation of the sale and forfeiture of the bid.

4. Shipping Costs

• Shipping costs are not included in your bid amount and will be charged separately to the buyer.
• For countries within the European Union, shipping is on a DDP (Delivery Duty Paid) basis, meaning all duties and taxes are included in the final price.
• For countries outside the European Union, including the United States, import duties may apply and must be paid by the buyer. Love Stories Intimates does not reimburse these import duty costs.

5. Delivery and Risk

• Items will only be shipped once full payment, including shipping costs, has been received.
• Love Stories Intimates will deliver the purchased auction item(s) to the address provided by the bidder at the time of checkout.
• Once the item has been delivered to the provided address, the risk of loss or damage transfers to the customer. Love Stories Intimates is not responsible for any damages or losses incurred after delivery.

6. Returns and Exchanges

• No Returns or Exchanges: Auction items are sold as-is and cannot be exchanged or returned under any circumstances, except in the case of a faulty item (see section 7).
• No Discounts or Gift Cards: Auction pieces are not eligible for any discount codes or gift cards.

7. Faulty Items

• If you receive an item that is damaged or faulty, please contact us immediately at shop@lovestoriesintimates.com within 7 days of receipt. We will review your claim and, if deemed valid, will take the necessary actions to address the issue.

8. Auction Format and Platform

• The auction is conducted via Instagram on the official Love Stories Intimates account. We reserve the right to modify or cancel the auction at any time without notice.

9. Privacy and Data Protection

• By participating in the auction, you agree that we may collect, store, and use your personal information in accordance with our Privacy Policy. Your data will be handled in compliance with the General Data Protection Regulation (GDPR) and other applicable European laws.

10. Governing Law and Disputes

• These Terms are governed by the laws of the Netherlands. Any disputes arising from the auction shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
• In case of any dispute, we encourage bidders to first contact us at shop@lovestoriesintimates.com to resolve the matter amicably.

11. Modification of Terms

• We reserve the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on our Instagram page. Participation in the auction after the changes implies acceptance of the updated Terms.

12. Liability

• Love Stories Intimates is not responsible for any technical issues or disruptions that may affect the ability to place or receive bids during the auction.
• To the extent permitted by law, Love Stories Intimates will not be liable for any indirect, incidental, or consequential damages arising from the auction process.

By participating in the auction, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
